General Conditions of Engagement

  1. General

    These terms and conditions apply to the services to be provided by Red Fox Thermography in accordance with the instructions received from the Client, as named in the booking form, as amended by any subsequent requested (and agreed) changes. Both the attached letter and these terms and conditions form the basis of the contract between Red Fox Thermography and the Client.  If you are wanting additional names added to the report, such as a family member or partner, you are agreeing our terms and conditions on their behalf.  Where other 3rd parties such as a housing association, Solicitor, Lender etc are listed on the report no contractual relationship is created with them.

    Subject to express agreement to the contrary and any agreed amendments/additions, the terms on which the Surveyor will undertake the Survey are set out below.

    We will process your personal data in accordance with the law for the purpose of providing the these and future services to you.  The nature of the data we process is your; name, address, telephone number, email address and property information.

    Should the Surveyor be unable to access any part of the property due to circumstances outside of their control an additional fee may apply should you wish those parts of the property to be included in a subsequent update of the report.

    Our surveys will be carried out in accordance with the relevant British Standard guidelines where safe and practical to so, however no items of furniture, ornaments or industrial equipment will be moved by the surveyor.

  2. Fees and Expenses

    To secure a survey we require the client to pay a 50% (or £100) payment after agreement to proceed. Upon completion the Client will pay Red Fox Thermography the outstanding balance, as per our invoice, for the report and any expressly agreed disbursements.  By paying the initial fee you agree to these terms and conditions.

    The report will not be issued until the outstanding balance has been paid in full.

  3. Complaints Procedure

    Red Fox Thermography has a formal complaints procedure in the unlikely event of dissatisfaction. A copy of this Procedure will be provided on request.

  4. Cancellation Policy

    We ensure a 14-day cooling off period after a survey is booked, providing any element of the survey does not occur within this period. Just notify us in writing within that period you can cancel the survey, and a full refund will be made for the initial booking.

    Once the survey has been undertaken (either the complete heat loss survey or thermal imaging aspect to the thermal imaging survey) the Client is liable pay the full balance due, irrespective of any cancellation request sent by the client after the survey, but before the report is delivered.

    Our cancellation policy is relevant within as well as outside the 14-day cooling off period and is:

    • If you cancel within 2 working days prior to the appointment date, there will be an additional administration fee of £50.
    • If you cancel on the day of the survey, full charges will apply.

    In agreement with the client, Red Fox Thermography may request a postponement of the thermal imaging aspect of the survey, to a mutually convenient date, in the event that weather conditions are not favourable for thermal imaging.  If the client is unable to accommodate this request, the survey can proceed on the originally agreed date, but Red Fox Thermography cannot be held liable for any assessment derived from the survey that may have been influenced by adverse environmental conditions on the survey date.

  5. Restriction on Disclosure

    The report to be provided shall be confidential to the Client for the specific purpose to which it refers.  It may be disclosed to the Client’s professional advisers, but it shall not be disclosed to any other person, nor reproduced in whole or in part without the prior written consent from the applicant, to specify who they would like it disclosed to.

    The Thermal Surveyor will accept responsibility to the Client alone that the report will be prepared with skill and care reasonable to be expected of a professional thermographer, but accepts no responsibility whatsoever to any other person other than the Client.

  6. Contracts (Rights of Third Parties) Act 1999

    Our liability in respect of this report is limited to you as our Customer.  There is no intention to confer any third party right as described in the Contracts (Right of Third Parties) Act 1999.

  7. The Service

    Accessibility and Voids

    The Surveyor will inspect as much of the surface area of the structure as is practicable but will not inspect those areas which are covered, unexposed or not reasonably accessible.

    Roofs

    The Surveyor will inspect the underside ceilings, and converted loft spaces, with reasonable access. Please note that hatches over stairs stairwells/staircases will not be considered accessible.

    Areas not inspected

    The Surveyor will note in their report if they were not able to check any parts of the property that the inspection would normally cover. If the Surveyor is concerned about these parts, the report tells you about any further investigations that are needed.  The Surveyor will not report on the cost of any work to put right defects or make recommendations on how these repairs should be carried out. However, if required, general advice with respect to ‘What to do now’ can be included in the report or provided separately upon request.

    Unless otherwise agreed beforehand, outbuildings, detached garages or other building not considered part of the main property will not be considered part of the survey.

    The Surveyor will not enter on to any Private land that is not in control of the Client.

    The Surveyor will state in his Report any restrictions on accessibility to the common parts or visibility of the structure.

  8. Insurance

    Red Fox thermography are insured and underwritten by Hiscox Underwriting Ltd. Details of our policy number and extent can be provided upon request.

  9. Limitation of Liability

    Our aggregate liability arising out of, or in connection with, this survey, whether arising from negligence, breach of contract, or any other cause whatsoever, shall in no event exceed 10 times the fee for the survey. This clause shall not exclude or limit our liability for actual fraud, and shall not limit our liability for death or personal injury caused by our negligence.
